However, foreign individuals can legally acquire property in Indonesia and enjoy full beneficial rights. Investment Bali always recommends to clients that they should secure the best legal advice when securing property in Bali. Below is some information regarding purchasing property in Bali, or Indonesia in general. There are a number of different types of title in Indonesia, that is: 1. Hak Milik (Freehold) is the type of title that can only be held by an Indonesian citizen. 2. Hak Pakai (essentially leasehold title) and other forms of title can be held by a PT or PMA Company (Foreign Investment Company). A non Indonesian citizen can&#8217;t own land in Indonesia. However a foreigner can acquire a leasehold title to a building, almost the same as a strata title except that the title lasts only for 25 years with an extension of 30 years for a maximum of 55 years and then reverts to the original owner. There are two ways for foreigners to own the land in Indonesia that is using The Nominee and PMA. The Nominee will sign four documents with the foreigner as follow: a. A Loan Agreement, acknowledges that the foreigner has lent to the Nominee the purchase price of the land. b. A Right of Use Agreement, allows the foreigner to use the land. c. A Statement Letter, where the Nominee acknowledges the foreigners loan and intention to own the land. d. Power of Attorney, the Nominee signs an irrevocable Power of Attorney giving the foreigner the complete authorities sell, mortgage, lease or otherwise deal in the land. The most significant change in Indonesian investment law came in 1997 when the government introduced the PMA (Penanaman Modal Asing or Foreign Investment Company). This allows foreign investors to set up a company in Indonesia, without having to have Indonesian partners. The PMA can be 100% owned by the foreign investor. PMA companies are allowed to own the title of the property for a period 25 years and have to be renewed by the government. 			<content:encoded><![CDATA[<p><img style="float:left;margin: 0 20px 10px 0;" src="http://farm4.static.flickr.com/3098/3159288534_23d24214e7_m.jpg" width="160" /> One of the leading British Developers in Spain have reported a significant rise in interest from British buyers seeking second homes in Spain.  Many developers are reporting an increase in the numbers of prospective purchasers now arriving along the Costa del Sol. <br/><br/>Despite the current exchange rate being unfavourable to Sterling, purchaser numbers have increased dramatically compared to the same period in 2009.  The majority of purchasers at the moment coming from the Scandinavian countries and surprisingly the UK and Ireland.  Following the recent Easter holiday period, the number of enquiries from Spanish purchasers has also increased dramatically. <br/><br/>Property Point Marbella have seen similar figures across the Costa del Sol in general.  Since the recent approval of the latest PGOU (Urban Plan), visitor numbers to the coast, specifically seeking holiday homes has increased significantly. <br/><br/>It is widely recognised that Marbella&#8217;s property market experienced a downturn long before the credit crunch thanks primarily to the lack of a recognised Urban Plan and subsequent findings of corruption which put many developments into question.  This in turn affected the mortgage market whereby banks were unwilling to lend against properties which had not received their final licence of occupation.  Now that we have an approved Urban Plan, 16,000 properties are now receiving their licences which means the banks can start lending and property becomes affordable to the mass market again. <br/><br/>The property market in Marbella has always been different from traditional national property markets.  The prime purchasing motive for most buyers being the climate and ease of access from all parts of Europe.  Marbella does after all retain its exclusivity and is quickly returning to the top of wishlists for many buyers who have strayed to other far flung destinations only to find their options restricted by reductions in travel options and less favourable weather. <br/><br/>Marbellas mayor, Angeles Munoz has published figures which show that for the first time in 4 years, since the outbreak of scandals which hit the coast and property market, sales of property have increased.  According to the figures published by Marbella Tax Office, 2,499 property sales were registered during the first quarter of 2010, a growth of 200% on the same period in 2009 and the highest number of sales recorded in the last 4 years. <br/><br/></p>

It is entered in the ‘Registro de la Propiedad&#8217;, the Property Registry, and is the only guarantee of title in Spain. It contains a description of the property, the details of the owner and any mortgages or legal claims that exist against the property. This document is important because it tells you if the seller is the owner of the property being sold. A nota simple contains further details of any mortgages or charges against the property and is also available from the Registry.The IBI receiptBefore purchasing a resale (not new) Spanish property check out the ‘lmpuesto sobre Bienes lnmuebles&#8217;, or lBI, which is the municipal property tax. Ideally, you&#8217;ll be able to see the IBI receipts for the last five years because that is the limit of liablity for unpaid back taxes and is attached to the property, not the owner. A new property bought from a developer will not have an IBI receipt (because it has never been ‘owned&#8217;) so it will be your responsibility to register the property for this tax.The Referencia CatastralEvery property sale must quote the ‘Referencia Catastral&#8217; of the property in question. The Catastro is another system of property registration in Spain, concentrating on the location, physical description and boundaries of the property. While the Property Registry focuses almost exclusively on ownership and title, the Catastro is concerned with property valuation.These two systems do not communicate with each other, and it is common to find that the catastral description of a property differs greatly from the one in the Property Registry. It is a good idea to request the actual certificate from the Catastro with a full description of the property. The certificate is in two parts, one being a description of the property and the other being either a plan or an aerial photograph.Community fees, statutes and minutes of the AGMThis only applies if you are buying a property in an urbanisation or where there are some ‘communal&#8217; resources, shared amongst a number of properties. These are the fees charged by the ‘Comunidad de Propietarios&#8217;, the Community of Property Owners, a legal body that controls all the elements held in common; the lift, gardens and pool for example. Each owner is assigned a quota, or percentage of the expenses which, by law, must be paid.Utility billsThese assure you that the bills are paid and also provide an idea of what the running costs of the property will be.MiscIf you are buying a property in an urbanisation, make sure that it is legal and registered by asking to see the approved ‘plan parcial&#8217; at the town hall. If the property is on the beach, make sure the development is also approved by the Jefatura de Costas. For a new property, make sure that it has been declared for IBI and that the developer has made the ‘declaracion de obra nueva&#8217;. Also ensure that the escritura mentions the house you are purchasing as well as the plot of land on which it stands. As an additional safeguard, it is wise to examine the town planning maps for the area around the property, called the Plan General de Ordenacion Urbana, or PGOU. <br/><br/></p>

Portugal is situated on the southwest of the Iberian Peninsula, which it shares with Spain, and its 800km of coastline all face the Atlantic. <br/><br/>Winters are particularly mild on the coast, and summers are hot but rarely unpleasant. The Atlantic air masses keep Portugal green and beautiful. But best of all, the country is largely unspoilt and the food and drink is fabulous. <br/><br/>  <br/><br/>The beaches along much of this coastline are sandy and very popular, with surfers from all over the globe coming to take advantage of the huge waves.<br />
Whether you are planning a holiday in Portugal or looking to buy property there, you will have lots to keep you occupied during your stay. Portugal was a hugely wealthy country about five hundred years ago when its maritime discoveries brought riches to the Iberian Peninsula. However, the Age of Discoveries ended along with the sixteenth century and Portugal slowly became a remote place compared to much of Europe.  <br/><br/>There are plenty of excellent golf courses in Portugal, especially in the Algarve where you can often combine sea views, sunshine and a round of golf quite happily.<br />

Portugal recommended to British buyers The country was praised by Country Life for offering a variety of leisure attractions and a slower, more relaxed pace of life.<br />
Portugal was also described as a charming destination that was very popular with tourists from the UK, partly because it offered hot and sunny weather all year round.<br />
Country Life stated that this had led to it becoming a hotspot for overseas property buyers, including expatriates and holiday home owners.<br />
According to figures cited by the magazine, Portugal is now home to more than 38,00 British expats.<br />
&#8220;Portugal has certainly been in the top five since those emigrating discovered the joys of one of the longest seasons in the Mediterranean,&#8221; it commented.<br />
According to official figures, a record number of British citizens set up home overseas during 2006.<br />
Portugal could be a good destination for overseas property buyers to consider, experts have advised.<br />
Investors According to the SaveBorrowSpend website, the Silver Coast region is proving to be especially popular with foreign investors, as it offers a number of bargains.<br />
The extent of its affordability was highlighted when the portal said a nine-bedroom house located in the area could be snapped up for just £160,000.<br />
Furthermore, it stated that apartments on the Silver Coast &#8211; an area well-known for its attractive beaches &#8211; would set people back about £40,000.<br />
SaveBorrowSpend added: &#8220;The downside is you will need to brush up on your Portuguese as hardly anyone in this region speaks English.&#8221;<br />
However, the portal said this meant the area was likely to be &#8220;relatively unspoilt&#8221; and appealing to people who enjoyed &#8220;breaking new ground&#8221;.<br />
This comes after financial services company Baydonhill predicted that Portugal would be one of the most popular markets for British investors this year.<br />
People in Ireland are acting quickly in order to avoid the possibility of missing out on cheap trips abroad next summer.<br />
Irish plan holidays in the sun Budget Travel stated that there had been unprecedented demand for last-minute holidays during summer 2007 because of the poor weather.<br />
However, demand was so high that it outstripped the available supply, which resulted in many being forced to brave the wet conditions in Ireland.<br />
This has led to many acting quickly this year instead of facing the possibility of missing out once again.<br />
According to Budget Travel&#8217;s head of marketing Clem Walshe, hot and sunny locations such as Portugal are proving to be very popular.<br />
He told the Irish Independent: &#8220;People definitely got caught out last summer &#8211; a lot of people couldn&#8217;t get the holiday they wanted.&#8221;<br />
Mr Walshe added that Spain was also attracting many Irish visitors, in particular the Costa del Sol.<br />
Last week, the Limerick Post quoted a local travel agent who said that the number of people heading abroad for the festive season was now higher than ever.<br />
Tony Brazil of Limerick Travel said that many of these were heading to places such as Spain and Portugal in order to stay in their holiday homes.<br />
Spending Christmas overseas is becoming increasingly common in Ireland, it has been reported.<br />
Irish holiday home owners head abroad The Limerick Post quoted a local travel agent who said that the number of people heading abroad for the festive season was now higher than ever.<br />
Tony Brazil of Limerick Travel stated that that Spain and Portugal were of the most popular destinations for a number of reasons, such as their hot weather and good transport links with Ireland.<br />
However, the fact that many people owned holiday homes in these countries was cited as another factor behind their appeal at this time of year.<br />
Mr Brazil commented: &#8220;There are a huge number of people now who own accommodation abroad and are spending the holidays in places like Malaga or Portugal.&#8221;<br />
He added that all the extra flights provided by low-cost-carriers had been proving to be very popular with Irish leisure travelers.<br />
According to the Association of British Travel Agents, a record number of people from the UK are also set to spend the festive season abroad this year. <br/><br/></p>
